This contract is for the purchase
of frozen semen from the Stallion Flexible and is made between H & MC Enterprises,
and the Mare Owner

The
Stud Fee of $2,500 includes:
A $500 nonrefundable Booking Fee
that is due at the time of the signing of the contract.
A
$2,000 Breeding Fee that includes 4 doses of frozen semen for covering 2
cycles. Each straw is 0.5 ml
and 4 straws are considered a breeding dose. Each
straw contains 175 million sperm which are least 50% motile.
The Mare Owner Agrees:
1.
The determination of the mare’s condition for breeding is
the Mare Owner’s responsibility.
2.
To have a culture and cytology performed on the mare, which
is free of infection or disease and in sound breeding condition.
3.
To have all unused straws returned by the veterinarian at
Mare Owner’s expense, no later than 45 days after last insemination.
4.
To complete and return the Mare History Form to the Stallion
Agent.
5.
It is the Mare
Owner’s responsibility to contact Carol Ives at Sport Horse Marketing
Internationale (503-638-7716) or carol@FlexibleGrandPrixJumper.com
at least 14 days in advance of ordering frozen semen.
6.
The frozen semen must be shipped to a veterinarian/clinic
that accepts and uses frozen semen. The
mare must be inseminated by a licensed veterinarian. Dr. Lisa Metcalf, MS
DVM Diplomate, who is the Reproductive Veterinarian that froze
Flexible’s semen, has recommended that one dose (4 straws) be
inseminated pre-ovulation and one dose (4 straws) be inseminated
post-ovulation. Insemination
instructions will be included in the shipping container. A total of 16
straws will be shipped to cover 2 cycles.
7.
Mare Owner agrees to pay handling and shipping fees for the
frozen semen including any courier fees that may be incurred in the
shipping of the frozen semen. Payment
of these fees is to be paid directly to Dr. Lisa Metcalf, MS DVM Diplomate
and arrangements can be made by calling Honahlee at (503) 682-3898 or
email Honahlee@imagna.com.
8.
After receipt of the frozen semen, the container must be
shipped back within seven (7) day using the prepaid Federal Express air
bill enclosed in the shipping container.
After 7 days a late container fee of $10 per day will be charged.
9.
Mare Owner will notify the Stallion Agent not later than 20
days after insemination of mare’s pregnancy status from the results of
an ultrasound administered by a licensed veterinarian.
10.
If a live foal (a foal that stands and nurses) is not
produced, a one-year return policy is included in the Breeding Fee. Proof
of such loss must be signed by a licensed veterinarian and presented to
the Stallion Agent within ten days of the death of the foal.
There will be a frozen semen straw charge of 20 for each straw
ordered.
11.
If the above named mare dies before being served, another
mare may be substituted with the Stallion Agent’s consent.
If the frozen semen has been shipped and the client does not wish
to substitute another mare, the semen must be returned at the Mare
Owner’s expense and a refund of the breeding fee will be returned.
A signed veterinary certificate will be required.
12.
If the above named mare does not ultra sound in foal after
two breeding cycles (inseminating the frozen semen by the above
recommended protocol #6) Mare Owner may purchase more straws, if
available, at $20 each. Due
to Flexible’s heavy show schedule in 2010, extra straws may not be
available until 2011.
13.
That Stallion Owner is not responsible for accident, illness,
disease or death of mare or the foal.
Stallion
Owner:
1.
The
Stallion Owner will provide viable frozen semen.
2.
Stallion Owner retains the right to refuse to breed the Mare Owner’s
mare at any time. Stallion
Owner will first deduct any costs incurred by the Mare Owner, and then
refund any unused portion. Booking
fees are nonrefundable.
The Stallion Owner and Mare Owner
mutually agree:
1.
This
contract is not valid unless completed and signed in full by both the
Stallion Agent and the Mare Owner.
2.
This
agreement is not assignable or transferable by Mare Owner to any other
party.
3.
This
agreement shall be interpreted, construed and governed by the laws of the
State of Oregon. If it is
necessary for either party to file a lawsuit arising out of
this
agreement, they will only file the lawsuit in Multnomah County in the
State of Oregon.
